By participating in any Auction, you acknowledge and agree to the following terms and conditions:
General Terms:
All items presented for sale at the Auction (“Items”, “Property”, “Product”, “Purchases”) are subject to these Terms and Conditions of Sale. These, together with specific terms outlined in materials and online, constitute the Comprehensive Terms and Conditions of Sale.
Vintage Estate Sales, LLC holds no responsibility for the accurate description, authenticity, or defect in any lot and does not provide any warranty in connection with them. Prospective buyers are advised to conduct on-site inspections. While Vintage Estate Sales, LLC strives for accuracy in item information, neither Vintage Estate Sales, LLC nor its Client assumes liability for Buyer’s bidding errors. Buyers are urged to inspect all items thoroughly. Descriptions and photos serve as guides only. Relying solely on photos for purchase decisions is discouraged; please review descriptions and inquire for clarification. Vintage Estate Sales, LLC is not accountable for errors, such as posting incorrect photos of items. In cases of uncertainty about an item’s condition, bid accordingly. Previewing auction items is possible by contacting Support@Vintage Estate Sales, LLC.com.
Condition & Warranties of Items:
ALL SALES ARE FINAL. A successful bid, whether live or online, forms a legally binding contract of sale. No refunds, returns, or exchanges will be entertained.
Any descriptions or samples provided by Vintage Estate Sales, LLC is solely for identification purposes and do not constitute any warranty, expressed or implied, that the item conforms to such descriptions or samples.
Buyers or their agents are responsible for inspecting all items upon which they intend to bid or purchase. All items are sold “AS IS,” “WHERE IS,” and “WITH ALL FAULTS.” VINTAGE ESTATE SALES, LLC DISCLAIMS ALL WARRANTIES, WHETHER WRITTEN, ORAL, OR IMPLIED, INCLUDING BUT NOT LIMITED TO QUALITY, AUTHENTICITY, CONDITION, SALEABILITY, USEABILITY, WEIGHT, MEASUREMENT, YEAR, MODEL, MECHANICAL CONDITION, PERFORMANCE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTY AGAINST PATENT, TRADEMARK, COPYRIGHT, OR TRADE SECRET INFRINGEMENT.
In the case of existing manufacturer warranties for purchased items, Buyers must handle all claims directly with the warranty provider. No statement in any paragraph herein shall contradict the provisions of this paragraph.
Payment:
By bidding on any item within the Vintage Estate Sales, LLC website/webpages, you are legally bound to purchase the item. The Total Price of the item(s) must be paid within 5 business days of the auction’s conclusion (Total Price = Bid Amount + Buyer’s Premium + Shipping Fees + Sales Tax). Payment methods accepted include online checks, credit cards, or debit cards for all buyers. Local buyers may use money orders, cashier checks, or cash in person during pick-up.
In the event of declined payment methods, Buyers have two (2) business days to contact the office (Support@Vintage Estate Sales, LLC.com) and make payment using a valid method. Failure to do so within two (2) business days will result in forfeiture of the item, and collection methods permitted by Arizona law will be initiated.
Vintage Estate Sales, LLC does not recognize or accept cancellations for any item won at auction for any reason. Attempting to “cancel” an item constitutes nonpayment. Should a winning bidder attempt to “cancel” an item after payment, no refunds will be issued under any circumstances.
Shipping & Pick-Ups:
Buyers are responsible for all shipping charges, which will be added to the total cost of the item(s). Shipping primarily utilizes the United States Postal Service (USPS) Priority Mail for most items. Shipping occurs on the Tuesday or Thursday following the auction, upon receipt of full payment. Actual shipping costs will be charged. No handling fees are added for most items; however, oversized or specialty items may incur actual handling fees for packaging and boxing materials. Please inquire before bidding for any shipping-related queries.
Should items remain uncollected beyond three (3) business days post-auction end, or in the case of lack of freight/large items shipping information within five (5) business days post full payment, said items will be deemed abandoned. Buyer forfeits any right, title, or interest in the items, and they will revert to Vintage Estate Sales, LLC without further notice.
Vintage Estate Sales, LLC reserves the right to recover all costs associated with the removal, storage, and resale of Buyer’s items, along with any other charges, fees, and expenses incurred due to Buyer’s failure, including attorney fees and costs to enforce Buyer’s obligations.
